Carroll County Grand Jury

CARROLLTON - Carroll County Prosecuting Attorney Donald R. Burns Jr., announced last week that Part II of the Carroll County Grand Jury met Tuesday, May 6, for a full-day session.

According to Burns, the Grand Jury heard testimony from 26 witnesses involving 27 cases.

Burns said that indictments were returned against the following:

MICHAEL A. NEUBERT, 53, of Walnut Street S.W., Sherrodsville, was indicted on one count of Theft and two counts of Forgery, all of which were felonies of the fifth degree. It is alleged that during February and March 2008, Neubert stole the checks of a local couple and used them to purchase items from the Dellroy gas station.

SARAH J. KUHN, 36, of South Canton Street, Malvern, was indicted on one count of Assault, a felony of the fourth degree. It is alleged that on March 29, 2008, Kuhn attempted to cause harm to a Carroll County Sheriff's Office deputy after her arrest on charges of Domestic Violence.

JOSEPH J. MAMMONE, 46, and SHANNON A. MAMMONE, 42, of Sycamore Road N.W., Malvern, were each indicted on one count of Cultivation of Marijuana and one count of Trafficking in Marijuana, all felonies of the third degree. It is alleged that on April 4, 2008, Drug Task Force Agents of the Carroll County Sheriff's Office discovered that the couple were growing and packaging marijuana for sale from their Sycamore Road residence.

STAFFORD E. CUMBERLEDGE, JR., 32, of Park Avenue N.E., Carrollton, was indicted on one count of Illegal Conveyance of Drugs of Abuse onto the Grounds of a Detention Facility. It is alleged that on March 10, 2008, Cumberledge reported to the Carroll County Jail to serve a jail sentence when corrections officers found drugs of abuse that Cumberledge was attempting to smuggle into the jail with him.

JEFFREY R. CLEARY, 31, of Crest Street, Carrollton, was indicted on three counts of Aggravated Vehicular Assault, each a felony of the second degree. It is alleged that on March 1, 2008, Cleary, while under the influence and while subject to a driver's license suspension, crashed his vehicle, causing serious physical harm to three passengers that were riding with him.

ADAM T. HYING, 20, of Stump Road, Minerva, was indicted on one count of Failure to Comply With Order or Signal of Police Officer, a felony of the third degree and one count of Receiving Stolen Property, a felony of the fifth degree. It is alleged that on April 5, 2008, while riding a motorcycle that had stolen license plates displayed, Hying fled from officers at a high rate of speed.

MICA R. LEGGETT, 22, of Caddy Road, Bowerston, and ALMA A. BRYAN, 34, of Mound Street, Sherrodsville, were each indicted on one count of Grand Theft, a felony of the fourth degree and CODY A. CRITES, 24, of Maple Grove Road, Uhrichsville, was indicted on one count of Receiving Stolen Property, a felony of the fifth degree. It is alleged that from September 2007 through March 2008, Leggett and Bryan were involved in a scheme of stealing instant lottery tickets from two local gas stations where they were employed. It is alleged that Leggett gave some of the stolen tickets to Crites.

JOSEPH B. SANDERS, 30, and STEVEN D. BUCKEY, 43, of CR 58 Timothy Ridge Road, Bergholz, were each indicted on one count of Aggravated Robbery, a felony of the first degree, one count of Kidnapping, a felony of the first degree and one count of Aggravated Burglary, a felony of the first degree with a specification that the pair used a firearm in the commission of the offenses. This case was presented to the Grand Jury for the second time due to a recent slip opinion issued by the Ohio Supreme Court in State v. Colon, No. 2008-Ohio-1624 which sets forth that an indictment must charge a mens rea element (culpable mental state) of a crime. Since the General Assembly did not include this element in some statutory offenses, a new indictment was necessary to avoid a potential legal issue concerning the sufficiency of the actual charging instrument. It is alleged that on Dec. 9, 2007, Sanders and Buckey broke into an Amsterdam home, robbed the occupant and drove him to Carrollton to withdrew money from his bank account. The victim was able to escape.

JASON W. HEFFNER, 28, of East Main Street, Salineville, and LAWRENCE R. ALLEN, 26, of Panama Drive, Malvern, were indicted on one count of Failure to Appear, a felony of the fourth degree. It is alleged that both defendants failed to appear for their scheduled Common Pleas Court dates for felony offenses after being released on recognizance bonds.

PATRICK A. BURNETT, 28 of Main Street, Leetonia, and SHAWN A. GRANT, 28, of Pearl Street, Leetonia, were each indicted on one count of Receiving Stolen Property, a felony of the fifth degree. It is alleged that on March, 2008, the pair were found to have stolen radiators and car batteries in their possession.

TODD W. LINDSAY, 43, of German Cemetery Road, Mineral City, was indicted on one count of Passing Bad Checks, a felony of the fifth degree. It is alleged that on Sept. 7, 2007, Lindsay uttered a bad check to a local car dealership.

PRISCILLA A. RAY, 59, of Macaw Road, Minerva, was indicted on one count of Assault, a felony of the fourth degree. It is alleged that on April 30, 2008, while working at a local home for mentally handicapped persons, Ray assaulted a resident that was under her care.

JOYCE A. AUSTIN, 50, of Parkland Drive S.W., Carrollton, was indicted on one count of Theft, a felony of the fifth degree and eleven counts of Forgery, each a felony of the fifth degree. It is alleged that between January and April 2008, Austin stole checks from a local medical-supply business where she was employed and used them for her own financial gain.

JOSEPH M. BOGGS, 21 of Ascot Road S.E., Carrollton and ROBERT S. SIKON, III, 30, of 2nd Street N.W., Carrollton, were each indicted on one count of Breaking and Entering, one count of Theft, and one count of Receiving Stolen Property, each a felony of the fifth degree. It is alleged that between April 15 and April 19, 2008, the pair trespassed onto property located on Pomona Road and removed more than $500 worth of scrap materials.

JESSICA R. KINNEY, 27, of Quarry Road, Jewett, was indicted on one count of Theft and one count of Forgery, each a felony of the fifth degree. It is alleged that on March 15, 2008, Kinney stole her grandmother's checks and used one to obtain $200 in cash.

BRETT R. WOOLEVER, 48, of 6 Valley St., Minerva, was indicted on one count of Burglary, a felony of the third degree. It is alleged that on April 20, 2008, Woolever broke into a Valley Street, Minerva, residence in order to recover money from a drug deal gone awry.

GARRY VANMETER, 39, of state Route 183, Magnolia, was indicted on one count of Breaking and Entering, a felony of the fifth degree. It is alleged that on April 24, 2008, Vanmeter trespassed onto property located on Pomona Road in order to remove various items located there.

NELSON D. JENKINS, 27, of Sinclair Avenue, Steubenville, was indicted on one count of Aggravated Possession of Drugs, a felony of the fifth degree. It is alleged that on April 24, 2008, Jenkins was found to have several "ecstasy" pills in his possession.

MALISSA N. BREYLEY, 30, of Kensington Road, Carrollton, was indicted on two counts of Forgery and one count of Theft, each felonies of the fifth degree. It is alleged that during March and April 2008, Breyley stole the checks of a Carroll County resident and used them to obtain hundreds of dollars in cash.

Burns also indicated that arraignments would be held before Judge Dominick E. Olivito, Jr., in the Carroll County Court of Common Pleas on Thursday, May 15, 2008, at 8 a.m.
