Carroll County Grand Jury

Carroll County Prosecuting Attorney Donald R. Burns, Jr., announced March 4 that Part I of the Carroll County Grand Jury met Wednesday, March 3, for a one-day session. According to Burns, the grand jury heard testimony from 13 witnesses involving 19 cases, 19 of which were returned as indictments.

Burns said indictments were returned against the following:

Aaron R. Fellure, 20, of 307 West Lincoln Way, Minerva, was indicted on three counts of Trafficking in Marijuana and one count of Possessing Criminal Tools, all felonies of the fifth degree. Christopher T. Hafner, of 217 N Market St., Minerva, was indicted on two counts of Trafficking in Marijuana and one count of Trafficking in Cocaine, all felonies of the fifth degree. It is alleged that during October and November 2009, the pair sold marijuana and cocaine and it is further alleged that Fellure used a cellular telephone to facilitate the offenses.

Robert E. Norman a.k.a. RobertT E. Norman, III, 27, of 215 N Grant St., Apt. 12, Minerva, was indicted on one count of Retaliation, a felony of the third degree. It is alleged that on Jan. 8, Norman threatened a witness in a criminal case.

Thomas G. Juarez, 21, of 15295 Liberty Church Road, Minerva, was indicted on two counts of Trafficking in Marijuana and one count of Trafficking in Drugs, all felonies of the fifth degree. Rachel M. Baker 28, of 503 W Plain St., Minerva, was indicted on one count of Trafficking in Marijuana, a felony of the fifth degree. Jamie M. Grogg, 19, of 14545 Liberty Church Road SE, Minerva, was indicted on one count of Trafficking in Marijuana and one count of Trafficking in Drugs, each a felony of the fifth degree with a specification for forfeiture of her automobile because it was used to facilitate the commission of a felony drug abuse offense. It is alleged that on or about October and November 2009, the trio sold marijuana and Alprazolam, a Schedule IV drug.

Bradley W. Soliday, 23, of 10484 Bayard Road, Apt. 6, Minerva, was indicted on one count of Trafficking in Marijuana, a felony of the fifth degree. It is alleged that on Oct. 13, 2009, Soliday sold marijuana.

Jesse T. Beaber, 20, of 122 Bonnieview Ave., Minerva, was indicted on two counts of Trafficking in Marijuana, each a felony of the fifth degree with a specification for forfeiture of his automobile because it was used to facilitate the commission of a felony drug abuse offense. It is alleged that on two occasions in October 2009, Beaber sold marijuana.

Brian J. Carroll, 20, of 1123 Mallow Road NE, Minerva, was indicted on two counts of Trafficking in Marijuana, each a felony of the fifth degree and one count of Aggravated Trafficking in Drugs, a felony of the fourth degree. It is alleged that during November 2009, Carroll sold marijuana and oxycodone, a Schedule II drug.

Benjamin K. Fenley, 22, of 126 E Main St., Apt. E, Jewett, was indicted on one count of Illegal Processing of Drug Documents, a felony of the fifth degree. It is alleged that on Feb. 9, Fenley altered a prescription and attempted to fill it at a Carrollton pharmacy.

Roger Eugene Myers, 41, whose last known address was 8248 Tartan Road, Scio, was indicted on one count of Failure to Provide Notice of Change of Address; Registration of New Address, a felony of the third degree. It is alleged that on or about Jan. 7, Myers had failed to report his change of address to the Carroll County Sheriff's Office under the law requiring address verification as a registered sex offender.

William K. Arkenburgh, 34, of 4198 Brenda Drive, Malvern, was indicted on one count of Cultivation of Marijuana, a felony of the fifth degree. It is alleged that on or about Aug. 7, 2009, Arkenburgh was found to be growing marijuana on his property.

Joshua A. Kincaid, 25, of 4007 Apollo Road, Mechanicstown, was indicted on one count of Theft, a felony of the fifth degree. It is alleged that on or about Dec. 26, 2009, Kincaid stole the jewelry of an acquaintance valued at more than $500.

Joshua I. Barrino, 20, of 2015 23rd St. NE, Canton, Leon S. McNutt, 32, of 802 Mahoning Road NE Canton, Charles P. Cottrell, 41, of 1702 3rd St. SE, Canton, and Michael L. Hogan, 28, of 2234 Saint Elmo Ave. NE, Canton, were each indicted on one count of Trafficking in Cocaine, a felony of the fifth degree. It is alleged that on or about Feb. 20, the aforementioned individuals were found to have cocaine in their possession that was packaged for resale.

Kenneth O. Capes, 52, of 803 McDaniel Ave., Minerva, was indicted on 21 counts of Theft, all felonies of the fifth degree. It is alleged that between 2007 and 2009, Capes stole tires from his employer and sold them for his own personal gain.

Robert E. Fox, 42, of 1717 Root Ave. NE, Canton, was indicted on one count of Failure to Appear, a felony of the fourth degree. It is alleged that on Jan. 21, Fox failed to appear for a hearing on a felony non-support case after being released on a recognizance bond.

Burns also indicated that arraignments would be held before Judge Dominick E. Olivito, Jr., in the Carroll County Court of Common Pleas on Thursday, March 11, at 8:30 a.m.
